Collaborative Law
Although Collaborative Law is not for everyone and is only one of a range of options, many families prefer an approach which is designed to meet their needs by:
- encouraging the parties to share their hopes, expectations and even fears with everyone working together to determine the shape of their futures;
- involving lawyers so advice can be given but in a way which is designed to provide a better chance of finding improved solutions for the family as a whole;
- providing an approach which is ethical and is not so much about winning but a common quest for solutions that are fair to the family as a whole;
- allowing the parties to have open discussions in such a way that they can avoid feelings of distrust, bitterness and unresolved anger.
It has been found that many families prefer the Collaborative Law process over the traditional for a number of reasons including:
- the conventional approach can often damage further an already fractured relationship, whilst the collaborative process is designed to assist the parties to communicate better, not only at the time of breakup but in the future;
- the process is designed to provide a value added element which the conventional process simply cannot provide;
- the collaborative lawyers have been specially trained in the collaborative process and will therefore be able to provide skills designed to find solutions rather than encourage an entrenched and positional approach.
